Terms and Conditions

Your Councillor Community Fund is provided by ßÙßÇÂþ»­. By submitting an application to us, you are agreeing to abide by our Priorities and Terms and Conditions (as listed below and as amended from time to time), in full.

Our Priorities

1. Your event, purchase or project will assist ßÙßÇÂþ»­ (SCC) in achieving one or more of the following priority objectives:

1.1 Growing a sustainable economy

1.2 Tackling health inequality

1.3 Enabling a greener future

1.4 Empowered and thriving communities

2. Your project will support the work of local community groups and/or communities

3. Your application will clearly demonstrate how it directly benefits the local community

4. Your application supports the Council's Equalities and Diversity policy

Terms and Conditions

5. You will discuss your event, purchase or project and obtain the support of your local councillor, prior to submitting your application

6. You will demonstrate how your project provides value for money in the use of public funds, and your application will include either a quotation, an estimate or full breakdown of your event, purchase or project costs

7. Your application will state:

7.1 Whether you are in receipt of other funds, or have any outstanding grant applications with ßÙßÇÂþ»­

7.2 Whether you have previously applied to ßÙßÇÂþ»­ for funding and for what purpose

7.3 Whether your organisation is already under contract to ßÙßÇÂþ»­ following a tendering process or is in receipt of a grant

7.4 Whether you have received any financial support from any public body in the current financial year and the two financial years immediately preceding

8. Your application will not include VAT where this is recoverable e.g. work carried out by ßÙßÇÂþ»­.

9. If Your Councillor Community Fund is to be used to supplement other ßÙßÇÂþ»­ funding, you will demonstrate the additional community benefit that this additional funding will deliver.

10. If you are a local authority, statutory body, charitable club or membership organisation, you will clearly demonstrate the wider community benefit of your project

11. You will use our funding solely for the purposes specified in your application. Should minor variations (e.g. changes to specified costings or timescales) be required, you will inform and seek approval from the ßÙßÇÂþ»­ Community Investment Team in writing, in consultation with the local councillor

12. You will provide evidence that the project has proceeded 6 months after the grant has been paid or as soon as the project has been completed. Should the project fail to proceed, you will inform the SCC Community Investment and Engagement Team and arrange for the funding awarded by ßÙßÇÂþ»­ to be repaid in full immediately

13. You confirm that your organisation has a linked bank account, and your organisation's bank account details have been provided on the Your Councillor Community Fund application form

14. You acknowledge that if your organisation has previously registered with ßÙßÇÂþ»­ as a vendor, we will make payment to the bank account details held on our payment system unless you specifically request otherwise in writing

15. You will assume full responsibility for obtaining all permissions, including licences and insurance required for your project in advance

16. You will assume full responsibility for any ongoing and future running costs or maintenance associated with the event, purchase or project, and will clearly state this in your application form

17. You will comply with all laws including, but not limited to, the General Data Protection Regulation ((EU) 2016/679) and the Data Protection Act 2018, Health and Safety at Work etc. Act 1974, Bribery Act 2010 and Subsidy Control Act 2022

18. You accept that ßÙßÇÂþ»­ has no liability for any consequences, whether direct or indirect, that may come about from the event, purchase or project or the use of the grant funding. You shall indemnify and hold harmless ßÙßÇÂþ»­, its employees, agents, officers or sub-contractors with respect to all claims, demands, actions, costs, expenses, losses, damages and all other liabilities arising from or incurred by reason of Your actions and/or omissions in relation to the event, purchase or project and the non-fulfilment of Your obligations under these terms and conditions

19. Subject to Clause 18, Your liability under these terms and conditions is limited to the amount of the grant funding.

20. These terms and conditions shall be governed by and construed in accordance with the law of England and the parties irrevocably submit to the exclusive jurisdiction of the English courts.

Publicity

21. You will acknowledge the provision of funds received from ßÙßÇÂþ»­ when referencing or publicising your event, purchase or project

22. You will submit evidence both of the expenditure (e.g. receipts, invoices) and the successful completion of the project (e.g. electronic photographs, press releases, awards) within 6 months of the receipt of funding or as soon as the project has been completed

23. By providing photographic evidence, you will give SCC permission to use the images on its website and other media platforms, including social and digital, and that all permissions have been granted to enable such use

Specific Exclusions and Restrictions

By signing these terms and conditions you are specifically acknowledging the following

24. Your organisation is not a political organisations (i.e. is not registered with the Electoral Commission www.electoralcommission.org.uk )

25. Your application and the event, purchase or project will not a. contravene ßÙßÇÂþ»­'s policies and priorities b. involve taking sides on a planning dispute c. bring the reputation of SCC into disrepute d. support organisations to directly campaign against ßÙßÇÂþ»­ or any local statutory partner

26. You will not apply for funding to cover expenditure wholly or primarily incurred for core costs incurred by schools. Specific school and Early Years finance rules apply

27. Receipt of the grant funding will not exceed your organisation’s Subsidy Control Guidance Minimal Financial Assistance (MFA) threshold of £315,000 cumulated over this and the previous two financial years, as specified in Section 36(1) of the Subsidy Control Act 2022

28. Receipt of the grant funding will be subject to You signing and returning the attached Minimal Financial Assistance letter so please sign and return as soon as possible.
